The website www.zehnhof.it (hereinafter also the “Site“) is owned by “Cantina ZEHNHOF di Rossi Giacomo”, a winery with headquarters at Via Antonio Rosmini, 52A, Roverè della Luna (TN), Italy, VAT no. 00510610223 (hereinafter also “Zehnhof” or “Cantina Zehnhof“) and is intended for the promotion and sale of Zehnhof products.

The Terms and Conditions set forth below:

– define and regulate the general conditions of use of the Site; all visitors must therefore fully comply with them;

– must be taken into consideration by all visitors, who must accept their content, failing which they will be prohibited from using the Site;

– may be modified by Zehnhof, which periodically updates them to visitors via the Site. Any changes made will be effective upon their publication on the Site and will apply only to transactions concluded subsequently. Visitors’ acceptance of these changes is deemed to be achieved by connecting to and/or using the Site. If visitors do not agree to the changes, they may not use the Site.

The Site and the Zehnhof product purchase and sale service are intended exclusively for visitors and customers of legal age. (>18 anni).

Visitors who wish to register and/or purchase Zehnhof products declare and guarantee that they are of legal age, that the personal data provided is true, up-to-date, and refers to them, and that they undertake to notify Cantina Zehnhof of such information should it be necessary to update it.

To purchase Zehnhof products, visitors must provide certain personal information and an email address to complete the purchase. Visitors who provide this information are solely responsible for ensuring the accuracy and timeliness of the information provided.

In any case, the user’s right to request the deletion of their data remains unaffected, by sending an email to the following address privacy@zehnhof.it specifying ‘Deletion of personal data’ in the subject line.

Products and their sale and purchase

 

All products, accompanied by price indications, constitute an offer to the public, with the details contained on the Website and in these Terms and Conditions.

The photographs illustrating the products are purely representative and are intended solely to present the products. Cantina Zehnhof therefore declines all responsibility and offers no guarantee regarding the correspondence between the graphic appearance of the products published and that of the products delivered.

All prices include VAT. Delivery and service management costs are not included in the product price unless expressly stated.

Visitors have the option to accept public offers and purchase Cantina Zehnhof products by selecting the products they are interested in in the “shop” section of the Site and adding them to their cart.

Once the minimum purchase amount has been reached, if specified on the Website, the visitor will be responsible for:

 

  1. check the products added to the shopping cart and their prices, as well as the total amount due;
  2. confirm your delivery and billing details;
  3. choose the payment method from those available;
  4. enter any coupon codes, if applicable, as indicated on the Website;
  5. proceed with the purchase order.

In the event of subsequent payment failure, the purchase order will be invalid and immediately canceled.

Acceptance by Zehnhof Winery of the purchase order will result in the immediate debit of the purchase amount according to the selected payment method.

Following acceptance of the order, the customer will receive an email confirmation of the purchase, specifically detailing the summary of the products ordered and their prices, the estimated delivery date, and the general and specific terms and conditions applicable to the order.

The customer may make payment via PayPal or credit card of their choice, using PayPal’s services as the payment system provider. The customer is connected to the PayPal website where they make the payment according to the methods accepted by PayPal and in compliance with the relevant conditions.

Cantina Zehnhof has the right to:

 

  • request additional information from the customer or ask them to send copies of documents proving ownership of the payment instruments used;
  • not to accept the purchase order and/or to terminate the sales contract with immediate effect if the customer fails to provide information and/or copies of documents proving ownership of the payment instruments used.


Under no circumstances shall Zehnhof be held liable for any fraudulent use of credit cards by third parties when paying for Products purchased on the Website.

For purchases made by VAT-registered persons, it is possible to request the issuance of an invoice by sending a special request via e-mail to info@zehnhof.it, including the billing information, the correctness of which the customer is responsible for. The latter is aware that in case of failure to send the above e-mail communication Cantina Zehnhof will be prevented from issuing the invoice.

Copies of receipts or invoices will be sent by Zehnhof following payment.

Zehnhof entrusts the delivery of products to professional couriers. The delivery of purchased products takes place at the address indicated by the Customer, provided that it is accessible by normal means of transport (no dirt roads, etc.). If the address provided by the Customer is not easily accessible, it is the Customer’s responsibility to notify Zehnhof, which reserves the right to confirm or cancel the order.

Delivery without the presence of the Customer is subject to the discretion of Zehnhof.

For any anomalies found in the Products, other than those due to the physiological deterioration of wine products or mere imperfections in the packaging, the User may contact the Company at the following e-mail address customercare@zehnhof.it, specifying the defects found and documenting them with photographic material.

Cantina Zehnhof shall not be liable under any circumstances for any delays occurring during transport.

 

Withdrawal

Visitors to the Website and those who intend to purchase Cantina Zehnhof products are aware that the right of withdrawal applies only to products purchased on the Website that can be returned to Cantina Zehnhof intact, with the relevant seal and put back on the market without any danger to consumer health. Therefore, goods that are likely to deteriorate or expire rapidly, sealed goods that have been opened after receipt, or goods that cannot be returned for hygiene or health protection reasons cannot be returned.

The Customer acknowledges that they may exercise their right of withdrawal for any reason, without providing explanations and without penalty, provided that no more than 14 (fourteen) days have elapsed since the date of receipt of the products. Withdrawal must be exercised by sending a written notice via email to the following address customercare@zehnhof.it, specifying the order number, date of purchase, date of receipt of the products and the customer’s name.

Upon receipt of the aforementioned notification, Cantina Zehnhof will open a return file and send the customer instructions to follow by email. Once the returned products have been received, Cantina Zehnhof will refund the customer within 14 (fourteen) days. The refund will be made using the same payment method used by the customer.

 

Obligations of visitors to the Website

Visitors to the Website undertake not to use it for illegal purposes or for purposes not covered by the Terms and Conditions set out herein and, in any case, without damaging or compromising the Website or preventing other visitors from using and enjoying the Website.

The visitor also undertakes (i) not to use machines, algorithms, software or other automatic functions to generate page or material requests, (ii) not to generate page requests through chain letters, e-mails or other means by which a person or group of persons is asked to consult a page, and (iii) to immediately notify Cantina Zehnhof in the event of a suspected breach of the security of the Website. e-mails or other means, through which a person or group of persons is asked to consult a page, and (iii) to immediately notify Cantina Zehnhof in the event of a suspected breach of the security of the Site.

 

Zehnhof’s obligations

Cantina Zehnhof undertakes to comply with the regulations regarding product storage until the products are delivered to the carrier; in any case, any liability relating to poor product condition resulting from improper storage after delivery is excluded.

Zehnhof Winery does not respond:

 

  • of the accuracy of the information and/or data contained on the Site;
  • of the information provided/acquired directly from individual third-party producers with respect to Zehnho;
  • of any damages resulting from the inaccessibility of the Site due to any reason whatsoever;
  • Content created or published on third-party sites to which the Site has a hyperlink (“link”). Visitors who decide to visit a website linked to the Site do so at their own risk and are responsible for taking all necessary measures against viruses or other malware.


Complaints regarding defects in the purchased products must be sent to Cantina, under penalty of forfeiture, within the following 48 (forty-eight) hours of delivery, by email to the address customercare@zehnhof.it, attaching photographic evidence of the dispute.

The customer is aware—and accepts—that sometimes not all the products listed in the order sent and accepted by Cantina Zehnhof may be delivered. In this case, Cantina Zehnhof will promptly refund the amounts for the undelivered products; under no circumstances will Cantina Zehnhof be held liable for any further loss and/or damage suffered as a result of the failed delivery.

Termination and termination of the Site’s services

Cantina Zehnhof reserves the right to immediately terminate a visitor’s access to and use of the Site at any time in the event of a breach by the visitor of their obligations under Articles 2 (Visitors), 3 (Products and their Sale), and 5 (Obligations of Site Visitors). With regard to these visitors, Cantina Zehnhof is authorized to cancel any orders placed and not yet delivered without prior notice.

Cantina Zehnhof may make improvements and/or changes to the Site at any time if this is necessary for technical reasons or to comply with current legislation.

Cantina Zehnhof may cease offering its products to the public, in whole or in part, at any time, without prejudice to the delivery of confirmed orders. In such cases, Cantina Zehnhof will promptly notify visitors via email and/or a notice on the Website.

 

Privacy Policy


Cantina Zehnhof processes the personal data of its customers in compliance with privacy legislation, as further specified in the information on the processing of personal data, Privacy Policy, available in the appropriate section of the Site.

 

Applicable law, disputes


The use of the Site and the orders placed for the purchase of products, as already regulated in this document and in general the relationships between Cantina Zehnhof, visitors to the Site and customers are governed by Italian law.

Pursuant to Article 49, paragraph 1, letter V of Legislative Decree no. 206 of 6 September 2005 (Consumer Code), visitors and/or customers may avail themselves of the joint conciliation procedure. The procedure may be initiated if visitors and/or customers, after submitting a complaint to Cantina Zehnhof, have not received a response within 30 (thirty) days or have received a response they deem unsatisfactory.

The visitor and/or customer who decides to avail of the conciliation procedure is obliged to send the request to the address customercare@zehnhof.it .

Pursuant to Article 14 of EU Regulation No. 524/2013, Registered Users may also use the “ODR” (Online Dispute Regulation) Platform, which can be accessed by clicking the following link: http://ec.europa.eu/odr

Any disputes connected and related to the use of the Site, which are not susceptible to resolution through the joint conciliation procedure, are reserved to Italian jurisdiction and to the exclusive and mandatory territorial jurisdiction of the Court of Trento.

Pursuant to and for the purposes of Articles 1341–1342 of the Italian Civil Code, the parties declare that they have read and understood, and therefore expressly approve, Articles: 2 (Visitors), 5 (Obligations of the Site Visitor), 6 (Zehnhof’s Obligations), 7 (Termination and Cessation of Site Services), and 9 (Applicable Law, Disputes).
